Welcome to EvictPro. These Terms of Service ("Terms") govern your access to and use of the EvictPro website, platform, and services (collectively, the "Service") operated by EvictPro ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Please read them carefully.

1. Service Description

EvictPro is a software-as-a-service (SaaS) platform that provides eviction case management tools and services for Maryland landlords, property managers, and eviction agents. Our Service includes:

  • Eviction case creation, tracking, and management through all stages of the Maryland eviction process
  • Document preparation, including Notices of Intent, court filings, and legal forms
  • A marketplace connecting landlords with qualified eviction agents
  • Secure online portal for case status updates, document uploads, and communication
  • Payment processing for services rendered

2. IMPORTANT: EvictPro Is Not a Law Firm

EvictPro is a technology platform and SaaS tool. We are not a law firm, and we do not provide legal advice, legal representation, or attorney-client relationships.

The information, documents, and services provided through our platform are for general informational and case management purposes only and should not be construed as legal advice. No attorney-client relationship is created by your use of the Service.

Our eviction agents are experienced professionals authorized to represent landlords in Maryland District Court rent cases under Maryland law, but they are not attorneys. Their services do not constitute the practice of law.

If you require legal advice, we strongly recommend consulting with a licensed Maryland attorney. Reliance on any information provided through EvictPro is solely at your own risk.

3. User Eligibility

To use our Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
  • Have the legal authority to enter into a binding agreement under these Terms
  • Not be prohibited from using the Service under applicable law

Our Service is designed for use within Maryland jurisdictions. While you may access the platform from other locations, all eviction case management services are provided exclusively for properties located in the State of Maryland and governed by Maryland landlord-tenant law.

4. User Accounts and Responsibilities

4.1 Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@evictpro.us if you suspect any unauthorized use of your account.

4.3 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law
  • Submit false, misleading, or fraudulent information through the platform
  • Attempt to gain unauthorized access to other user accounts or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, threaten, or intimidate any individual
  • Use automated means (bots, scrapers, etc.) to access the Service without our express written permission

5. Payment Terms

5.1 Pricing and Fees

Pricing for our services is displayed on our Pricing page. All prices are in U.S. dollars. We reserve the right to change our pricing at any time, but changes will not affect services already purchased or active subscriptions during their current billing period.

5.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's terms of service. We do not store your full payment card information on our servers.

5.3 Refunds

Refund eligibility depends on the type of service purchased and the stage of case processing. If you are dissatisfied with our services, please contact us at support@evictpro.us to discuss your options. Court filing fees paid to the court on your behalf are non-refundable. Detailed refund terms are provided at the time of purchase.

5.4 Subscriptions

If you purchase a subscription plan, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, content, code, graphics, logos, and trademarks, is owned by EvictPro and protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6.2 Your Content

You retain ownership of all content you submit to the Service, including case information, documents, and communications. By submitting content, you grant EvictPro a limited, non-exclusive license to use, process, and store your content solely for the purpose of providing the Service to you. We will not use your content for any purpose unrelated to providing our services without your consent.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVICTPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Indemnification

You agree to indemnify, defend, and hold harmless EvictPro and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit through the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in the State of Maryland, and you consent to the personal jurisdiction of such courts.

10. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at support@evictpro.us. We will make good-faith efforts to resolve the dispute within 30 days.

If the dispute cannot be resolved informally, either party may bring a claim in the state or federal courts located in the State of Maryland. You agree to submit to the exclusive jurisdiction of the courts of Maryland for any disputes not resolved through informal negotiation.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at support@evictpro.us or through your account settings. Termination does not relieve you of any obligations to pay fees incurred prior to termination.

11.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate the Service entirely with 30 days' notice.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law. We will retain your data in accordance with our Privacy Policy retention schedule.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page, updating the "Last updated" date, and, where appropriate, sending you an email notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and EvictPro regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
