Terms of Service

Welcome to EvictPro. These Terms of Service ("Terms") govern your access to and use of the EvictPro website, platform, and services (collectively, the "Service") operated by BMP Property Management LLC, a Maryland limited liability company doing business as EvictPro ("EvictPro," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Please read them carefully.

1. Service Description

EvictPro is a software-as-a-service (SaaS) platform that provides end-to-end eviction case management for Maryland landlords, property managers, law firms, and independent eviction agents. Our Service includes:

  • Free generation of legally compliant Notices of Intent for Maryland landlords and property managers
  • Eviction case creation, tracking, and management through every stage of the Maryland failure-to-pay-rent process, from notice through eviction day
  • Preparation of Maryland court forms, including but not limited to DC-CV-082 (Failure to Pay Rent complaint) and DC-CV-081 (Warrant of Restitution)
  • A marketplace connecting landlords with experienced, independent eviction agents
  • Subscription tiers for individual eviction agents and law firms, enabling multi-member firm portfolios, case assignment, and financial reporting across the firm
  • A secure online portal for case status tracking, real-time stage timelines, document storage and sharing, and direct messaging between landlords and their assigned agents
  • Payment processing for per-stage services, packages, add-ons, and subscriptions
  • Analytics and reporting features, including rent-recapture metrics and portfolio-level financial summaries

Different features are available to different user types (landlords, eviction agents, firm managers, firm members, and administrators), and different billing models apply to each. These Terms apply to all users.

2. IMPORTANT: EvictPro Is Not a Law Firm

EvictPro is a technology platform and SaaS tool. We are not a law firm, and we do not provide legal advice, legal representation, or attorney-client relationships.

The information, documents, and services provided through our platform are for general informational and case management purposes only and should not be construed as legal advice. No attorney-client relationship is created by your use of the Service.

Eviction agents who appear on the platform are experienced professionals authorized to represent landlords in Maryland District Court rent cases under Maryland law. Unless separately identified as a licensed Maryland attorney, an agent is not a lawyer, and their services do not constitute the practice of law.

Eviction agents are independent contractors, not employees of EvictPro. Each agent operates as an independent 1099 contractor and is solely responsible for the manner in which they perform services, including the accuracy of filings, their conduct in court, their communications with landlords and tenants, and their compliance with applicable law. While EvictPro vets agents before allowing them on the platform and may remove agents who violate our platform rules, EvictPro does not direct, control, or guarantee the professional judgment of any agent. Your engagement with an agent creates a direct relationship between you and that agent, separate from your relationship with EvictPro.

If you require legal advice, we strongly recommend consulting with a licensed Maryland attorney. Reliance on any information provided through EvictPro is solely at your own risk.

3. User Eligibility

To use our Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
  • Have the legal authority to enter into a binding agreement under these Terms
  • Not be prohibited from using the Service under applicable law

Our Service is designed for use within Maryland jurisdictions. While you may access the platform from other locations, all eviction case management services are provided exclusively for properties located in the State of Maryland and governed by Maryland landlord-tenant law.

4. User Accounts and Responsibilities

4.1 Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately through our Contact page if you suspect any unauthorized use of your account.

4.3 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law
  • Submit false, misleading, or fraudulent information through the platform, including but not limited to false rent ledgers, fabricated notices, or misrepresentations about property ownership
  • Attempt to gain unauthorized access to other user accounts or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, threaten, or intimidate any individual, including tenants beyond what is required for the lawful pursuit of an eviction
  • Use automated means (bots, scrapers, etc.) to access the Service without our express written permission

5. Payment Terms

5.1 Pricing and Fees

Pricing for our services is displayed on our Pricing page. All prices are in U.S. dollars. All per-stage prices displayed on our Pricing page are all-inclusive of applicable court filing fees. We reserve the right to change our pricing at any time, but changes will not affect stages already purchased or active subscriptions during their current billing period.

5.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's terms of service. We do not store your full payment card information on our servers.

5.3 Refunds

EvictPro services are delivered progressively — each stage of an eviction case involves court filings, document preparation, agent time, and third-party fees paid on your behalf. Because much of this work cannot be reversed once performed, our refund policy reflects how and when services are rendered. All refund decisions are made in EvictPro's reasonable discretion, consistent with the rules below.

(a) Per-stage services (Filing, Court Hearing, Tenant Response Review, Warrant, Sheriff Scheduling, Eviction Day). You are charged for a stage only when you authorize it. A stage is considered "in progress" once your assigned agent has accepted the assignment, begun drafting documents, submitted a filing, or otherwise started work. Refunds on per-stage services follow this schedule:

  • Before work begins: you may cancel and receive a full refund of the stage fee, less any non-refundable court filing fees already paid to the court on your behalf.
  • After work begins but before completion: no refund is available for the stage in progress.
  • After stage completion: completed stages are non-refundable.

(b) Package purchases (including the Full Eviction Service package). Packages are priced at a discount relative to à la carte stages because they reflect a commitment to the full workflow. You may cancel future stages within a package before work on those stages begins; you will receive a prorated refund equal to the à la carte price of unperformed stages, minus any discount previously applied. Stages already completed or in progress are non-refundable.

(c) Court filing fees and third-party fees. Court filing fees (including but not limited to DC-CV-082 and DC-CV-081 fees), sheriff fees, and any other fees paid by EvictPro to a court, sheriff's office, or other third party on your behalf are never refundable by EvictPro. Once paid to the court or third party, these funds are outside our control. If the court issues a refund to us, we will pass it through to you.

(d) Add-ons (SCRA verification, Rush Processing, and similar). Add-ons are performed services. Once we begin the add-on service, it is non-refundable. You may cancel before the service begins for a full refund.

(e) Agent subscriptions (AGENT_BASIC, AGENT_PRO, FIRM) and firm seat billing. Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected). You may cancel at any time; cancellation takes effect at the end of the current billing period, and prorated refunds are not available for partial periods. If you downgrade your subscription tier, the downgrade takes effect at the end of the current billing period. Upgrades take effect immediately and are prorated against the remainder of the current period. If a subscription lapses during an active case, existing cases remain accessible in read-only status; creating new cases or advancing existing stages requires a current subscription.

(f) Notice of Intent (NOI). Notices of Intent are provided free of charge. No payment, no refund.

(g) Good-faith cancellation window. You may request a full refund of any stage or add-on within twenty-four (24) hours of purchase, provided no work has yet begun. If work has begun, subsection (a) or (d) applies.

(h) Service we cannot perform. If we are unable to perform a purchased service — for example, because no qualified agent is available in your jurisdiction, a court refuses to accept a filing due to a defect we introduced, or a sustained platform failure prevents service delivery — we will issue a full refund of the affected stage or add-on.

(i) Disputed charges. You must raise any disputed charge with EvictPro within sixty (60) days of the charge date, consistent with standard payment-card-network rules. We reserve the right to contest chargebacks submitted without first engaging with our support process.

(j) Payment plans. If you have an active payment plan and we terminate service for any reason, you remain obligated to pay for work already completed. Refund rules in subsections (a) – (h) continue to apply to any amounts for stages not started.

(k) How to request a refund. Submit a refund request through our Contact form with your case number and the reason for the request. We aim to respond within five (5) business days.

5.4 Subscriptions

Agent and firm subscription plans automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or through our Contact page. Cancellation takes effect at the end of the current billing period. Subscription refund rules are described in Section 5.3(e) above. For firm subscriptions, the designated firm administrator is responsible for billing on behalf of the firm and for managing member seats; removed members' assigned cases remain under firm ownership and do not terminate.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, content, code, graphics, logos, and trademarks, is owned by EvictPro and protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6.2 Your Content

You retain ownership of all content you submit to the Service, including case information, documents, and communications. By submitting content, you grant EvictPro a limited, non-exclusive license to use, process, and store your content solely for the purpose of providing the Service to you. We will not use your content for any purpose unrelated to providing our services without your consent.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVICTPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

WITHOUT LIMITING THE FOREGOING:

  • EVICTPRO IS NOT LIABLE FOR THE OUTCOME OF ANY EVICTION CASE, INCLUDING BUT NOT LIMITED TO WHETHER A COURT GRANTS OR DENIES A JUDGMENT, THE AMOUNT OF ANY JUDGMENT, OR THE TIMING OF A WARRANT OF RESTITUTION OR PHYSICAL EVICTION. CASE OUTCOMES DEPEND ON FACTS, THIRD-PARTY CONDUCT, COURT DISCRETION, AND OTHER FACTORS OUTSIDE EVICTPRO'S CONTROL.
  • EVICTPRO IS NOT LIABLE FOR THE ACTS OR OMISSIONS OF EVICTION AGENTS SELECTED THROUGH OUR MARKETPLACE. EVICTION AGENTS ARE INDEPENDENT CONTRACTORS, NOT EMPLOYEES OF EVICTPRO, AND ARE RESPONSIBLE FOR THEIR OWN PROFESSIONAL CONDUCT.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Indemnification

You agree to indemnify, defend, and hold harmless EvictPro and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including fair-housing laws; (d) any content you submit through the Service, including false or misleading representations made to a court via documents generated on the platform; or (e) your misuse of tenant personal information obtained through the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Subject to the arbitration provisions in Section 10, any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in the State of Maryland, and you consent to the personal jurisdiction of such courts.

10. Dispute Resolution

10.1 Informal Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us through our Contact page. We will make good-faith efforts to resolve the dispute within thirty (30) days.

10.2 Binding Arbitration

If the dispute is not resolved through informal negotiation within thirty (30) days, you and EvictPro agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by JAMS in accordance with the JAMS Streamlined Arbitration Rules and Procedures, as modified by these Terms. The arbitration shall be conducted by a single arbitrator and, unless otherwise agreed, shall take place in Baltimore, Maryland, or by video or telephone conference where reasonably practicable. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

10.3 Small Claims Carve-Out

Notwithstanding Section 10.2, either party may bring an individual action in small claims court for disputes within the scope of that court's jurisdiction, provided the action remains on an individual, non-class basis.

10.4 Class-Action Waiver

YOU AND EVICTPRO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class-action waiver is found to be unenforceable, then the entirety of Section 10.2 (Binding Arbitration) shall be null and void as to the affected claim, and the claim shall proceed in court as provided in Section 9, but this Section 10.4 otherwise remains in full force and effect.

10.5 Opt-Out Right

You may opt out of the arbitration and class-action-waiver provisions in Section 10.2 and 10.4 by sending written notice via our Contact page within thirty (30) days of first accepting these Terms. An opt-out does not affect any other provision of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings or through our Contact page. Termination does not relieve you of any obligations to pay fees incurred prior to termination.

11.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate the Service entirely with 30 days' notice.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to intellectual property rights, limitation of liability, indemnification, governing law, and dispute resolution. We will retain your data in accordance with our Privacy Policy retention schedule.

Active cases. Termination of your account does not automatically close active eviction cases. Active cases will continue to completion under the supervision of your assigned agent, and you will remain obligated to pay for stages you authorize during that period. EvictPro may, in its reasonable discretion, reassign an active case to another qualified agent or return the case to you to pursue independently if the terminated account is an agent or firm account.

12. Anti-Discrimination

You represent and warrant that, in using the Service, you will comply with all applicable anti-discrimination and fair-housing laws, including the federal Fair Housing Act, the Maryland Fair Housing Law (Md. State Gov't § 20-701 et seq.), and any applicable county or municipal fair-housing ordinances. You will not use the Service to discriminate against any tenant or prospective tenant on the basis of race, color, national origin, religion, sex, familial status, disability, sexual orientation, gender identity, source of income, or any other protected characteristic.

Material violation of this Section 12 is grounds for immediate termination of your account under Section 11.2 and may be reported to the appropriate regulatory authorities as required by law.

13. Third-Party Services

EvictPro integrates with trusted third-party service providers to deliver certain platform features. Your use of the Service may be subject to the terms of those providers. These include:

  • Stripe — payment processing
  • Vercel — application hosting and content delivery
  • Supabase — database and authentication
  • Resend — transactional email delivery
  • PostHog — product analytics
  • Sentry — error monitoring

We disclose categories of third-party data recipients and the data shared with each in our Privacy Policy. EvictPro is not responsible for the acts, omissions, or terms of these third-party service providers beyond our own reasonable diligence in selecting them.

14. Communications

By creating an EvictPro account, you agree that we may send you transactional and service-related emails — including account notifications, notice and case status updates, payment receipts, and security alerts. These messages are necessary to operate the Service and cannot be opted out of while your account is active.

EvictPro may also send periodic marketing communications, including product updates, educational content about Maryland landlord-tenant law, and resources we believe will be useful to you. You will be asked to opt in or out of these communications when you create your account and on certain free tools. You may change your preference at any time from your account settings or by clicking “unsubscribe” in any marketing email. Opting out of marketing communications does not affect your receipt of transactional emails.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page, updating the "Last updated" date, and, where appropriate, sending you an email notification or an in-app notice. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and EvictPro regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
  • Force Majeure: Neither party will be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, government action, court closures, labor disputes, or failures of third-party infrastructure.
